BANKRUPTCY AND INSOLVENCY
We have expertise in all areas of bankruptcy
and insolvency law, including debtor and
creditor rights, state court receiverships,
foreclosures, and out-of-court workouts.
While we most often represent banks, lending
institutions, equipment lessors and other
creditors in all types of bankruptcy and
insolvency proceedings, we also have significant
experience in representing commercial debtors.
We regularly
appear before all United States Bankruptcy
Courts in North Carolina, as both primary
and local counsel and are primary counsel
in many bankruptcy matters outside of
North Carolina. We handle all forms of
bankruptcy litigation involving such complex
issues as preferences, fraudulent conveyances,
equitable subordination, relief from automatic
stay, involuntary petitions, asset purchases,
plan confirmation, and cash collateral
and cram down issues. We also regularly
consult with clients, both debtors and
creditors, on bankruptcy avoidance, workouts
and financial restructuring.

ENVIRONMENTAL
We counsel our clients on a wide variety
of environmental issues, including regulatory
compliance, governmental clean up actions,
environmental assessment analysis, enforcement
litigation, worker safety, toxic tort
litigation, informational reporting requirements,
municipal water and sewer projects, waste
disposal practices, permit applications,
insurance coverage disputes, asbestos
removal, and lender liability. We regularly
interact with governmental agencies such
as the North Carolina Department of Environment
and Natural Resources and the United States
Environmental Protection Agency regarding
the interpretation and application of
state and federal environmental laws and
regulations.
We also coordinate
with other attorneys in the firm to provide
our clients with the information necessary
to understand the sometimes significant
and unanticipated implications of environmental
laws on personal and business planning,
business organization, real estate transactions,
and creditors' rights. We work with our
clients to develop creative approaches
to the environmental aspects of their
business transactions.
